Purpose of Post:

The Mental Health Review Tribunal (MHRTW) hears applications for review from patients detained under the Mental Health Act 1983 (amended 2007). The MHRTW provides a significant safeguard for those who have had their liberty curtailed under the Mental Health Acts. The purpose of this post is to work as part of a team based in Cardiff providing a Secretariat role for the MHRTW by managing cases through the appeals process. The post holder will ensure that action on the preparation of papers, the arrangement of Tribunal hearings and any follow up action is delivered in compliance with statutory requirements and within timescales. The post holder will be expected to attend hearings across Wales.

Key tasks:

•           Facilitate, manage and clerk tribunal hearings across Wales to areas where public transport is limited. Travel is required on a weekly basis.  

 

•           Ensure that applications received in the tribunal office are appropriately made. Oversee and take responsibility for your own cases that are geographically allocated. Information is entered and managed on the CRM case management database with detail to accuracy.

 

•           Arrange tribunal hearings within statutory timescales and best practice guidelines.

 

•           Ensure that files are prepared for hearings and that the relevant reports have been requested from the appropriate authority.  These must be received within statutory timescales and are compliant with the Mental Health Review Tribunal for Wales Rules 2008 and Code of Practice for Wales.

 

•           Check reports for compliance and issue to all parties involved in the case, within 3 days of receipt, and to tribunal panel members within 14 days of a tribunal hearing.

 

•           Undertake post-hearing action and issue the tribunal decision within statutory timescales.

 

•           In addition to your own caseload, oversee and manage other colleagues case work during times of absence.

 

•           Line management of one Tribunal Support Officer, or proactively support the pool of Tribunal Support Officers ensuring they work to the best of their ability

 

•           Provide administrative support to Operational and Strategic Business Managers as required.
